1. Who you are contracting with

FitQuest ("the app", "we", "us") is operated by RETHYN LTD. By creating an account or continuing to use the app, you agree to these terms. If you are using the app on behalf of an organisation, you confirm you have authority to bind it. FitQuest is for adults: you must be 18 or over to create an account, and setup does not continue for anyone under 18.

2. What the app is

FitQuest is a gamified food, exercise and habit tracker. It provides estimates for calories and macros based on public food databases and standard formulas. It is a general wellbeing tool and is not medical, dietary or clinical advice. Always speak to a qualified professional before making significant changes to your diet or exercise routine.

3. Your account

Keep your login details confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date — the calorie targets the app generates depend on it.

4. Acceptable use

You must not use the app unlawfully, commit fraud or spam, infringe anyone's intellectual property, or interfere with its security (including malware, probing, scraping or circumventing technical limits). You must not reverse engineer, resell or redistribute the app.

5. Intellectual property

We retain ownership of the app, its software, artwork, character designs, branding and documentation. Your Quest Pass grants a limited, non-exclusive, non-transferable right to use the app within your chosen plan. You keep ownership of the data you enter, and grant us a limited licence to host and process it solely to provide the service.

6. Service level

We work hard to keep the app running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose. Our aggregate liability is capped at the fees you paid in the previous 12 months, and we exclude indirect or consequential losses. Nothing here excludes liability for fraud, death or personal injury caused by negligence.

7. Payment and subscriptions

New accounts get 14 days of full FitQuest access free, with no card required. No paid subscription is created when you sign up. During or after the free trial you can choose to buy a Quest Pass, which on our website is £4.99 per month or £39.99 per year. If you choose a Pass during the trial, billing begins when your original trial ends; if you choose one after the trial has ended, billing begins immediately. If you do not choose a Pass, your adventure pauses when the trial ends and your account and progress are kept. Quest Pass subscriptions renew automatically until cancelled, and cancelling takes effect at the end of the period you have already paid for.

Where the Quest Pass is offered inside the FitQuest iPhone or Android app, it is sold through the App Store or Google Play. Price, currency and any trial are shown by the store before you confirm, the charge is made to your store account, and renewal, cancellation and refunds are managed in your App Store or Google Play account under the store's terms. Store purchases in the apps are being prepared and may not yet be available.

Whichever way you subscribe, the Quest Pass unlocks the same features on the same account. If you already have a Quest Pass from one source, you do not need another.

8. Seller and payment processing

The Quest Pass is sold by RETHYN LTD, United Kingdom. Website payments are processed by Stripe, which issues your receipts and invoices; we never see or store your card details, and we handle cancellations and refunds for website purchases directly — email hello@fitquestxp.co.uk. For purchases made through the App Store or Google Play, Apple or Google processes the payment and handles refunds under its own policies.

9. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may export your data for 30 days, after which it may be deleted. You can delete your own account at any time from Account settings or at fitquestxp.co.uk/delete-account.

10. General

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. You may not assign your rights without our consent; we may assign ours as part of a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
