1. Who you are contracting with

FitQuest ("the app", "we", "us") is operated by Animal Fitness Quest (L Taylor). By creating an account or continuing to use the app, you agree to these terms. If you are using the app on behalf of an organisation, you confirm you have authority to bind it; otherwise you confirm you are of legal age in your country.

2. What the app is

FitQuest is a gamified food, exercise and habit tracker. It provides estimates for calories and macros based on public food databases and standard formulas. It is a general wellbeing tool and is not medical, dietary or clinical advice. Always speak to a qualified professional before making significant changes to your diet or exercise routine.

3. Your account

Keep your login details confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date — the calorie targets the app generates depend on it.

4. Acceptable use

You must not use the app unlawfully, commit fraud or spam, infringe anyone's intellectual property, or interfere with its security (including malware, probing, scraping or circumventing technical limits). You must not reverse engineer, resell or redistribute the app.

5. Intellectual property

We retain ownership of the app, its software, artwork, character designs, branding and documentation. Your Quest Pass grants a limited, non-exclusive, non-transferable right to use the app within your chosen plan. You keep ownership of the data you enter, and grant us a limited licence to host and process it solely to provide the service.

6. Service level

We work hard to keep the app running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose. Our aggregate liability is capped at the fees you paid in the previous 12 months, and we exclude indirect or consequential losses. Nothing here excludes liability for fraud, death or personal injury caused by negligence.

7. Payment and subscriptions

The Quest Pass is £4.99 per month or £39.99 per year, each starting with a 14-day free trial. Subscriptions renew automatically until cancelled, and cancelling takes effect at the end of the period you have already paid for. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms.

8. Merchant of record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may export your data for 30 days, after which it may be deleted.

10. General

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. You may not assign your rights without our consent; we may assign ours as part of a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
